Murra,· Supervisor ofR ecords September 2 7, 20 J 7 SPR17/1342 John Mullin Pittsfield Police Department 3 9 Allen Street Pittsfield, MA 01201 Dear Captain Mullin: I have received the petition of Seth Kershner appealing the nonresponse of the Pittsfield Police Department (Department) to his request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Kershner requested "any incident reports, after-action review or other written reports documenting the deployment of the Berkshire County SRT to an Ashley Falls location" on a specifically identified date. Claiming to not yet have received a response, Mr. Kershner petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department intends on providing Mr. Kershner with a response to his appeal. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide J\1r. Kershner with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre<@sec.state.ma.us. J\1r.
