Kirchofer appealing the nonresponse of the Massachusetts Department of Transportation (MassDOT) to his request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Attorney Kirchofer requested seven categories of records which he believes are in the possession ofMassDOT. Claiming to not yet have received a response, Attorney Kirchofer petitioned this office and this appeal was opened as a result. To date, it remains unclear whether MassDOT has provided a response or not to Attorney's Kirchofer's request. Accordingly, MassDOT is hereby ordered to provide a response to Attorney Kirchofer without delay. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state..ma..us. Attorney Kirchofer may appeal the substantive nature ofMassDOTs response within ninety days.
