G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Morgan requested various records within the possession of Massport concerning flight patterns, air traffic, and plane altitude. Claiming to still not yet have received a response, despite a previous order from this office, Mr. Morgan petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from Massport intends on providing Mr. Morgan with a response. Accordingly, I will consider this administrative appeal closed with the proviso that Massport provide Mr. Morgan with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre({Osec.state.ma.us. Mr. Morgan may appeal the substantive nature ofMassport's response within ninety days.
