Box 1969 Pittsfield, MA 01202 Dear Attorney Pieropan: I have received the petition of Colman Herman appealing the nonresponse of the Berkshire District Attorney's Office (Office) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Herman requested expense records of an identified Office employee. Having received no response, Mr. Herman petitioned this office. Subsequentto the intervention by a member of the Public Records Division staff, this office was notified that a response was provided, dated October 3, 2017. Whereas this matter was opened based upon the Office's failure to provide a written response, I will now consider this administrative appeal closed.
