Assistant City Solicitor Lowell Law Department 375 Merrimack Street, 3rd Floor Lowell, MA 01852 Dear Attorney Wellock: I have received the petition of Arthur Grenier appealing the nonresponse of the Lowell Law Department (Department) to his request for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Grenier requested "the entire Internal Affair[s] and/or Professional Standard files" for an identified individual. Claiming to not yet have received a response, Mr. Grenier petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member ofthe Public Records Division, I learned that a representative from the Department intends on providing Mr. Grenier with a response. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Grenier with said response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Grenier may appeal the substantive nature of the Department's response within ninety (90) days.
