Champagne Clinton Police Department 176 Chestnut Street Clinton, MA 01510 Dear Mr. Champagne: I have received the petition of Michael Dreslinski appealing the response of the Clinton Police Department (Department) to his request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Dreslinski requested four categories of records including "rap sheets," photos related to officers' formal reports, an officer's formal report, and log inventory report. The Department provided an initial response indicating they were withholding the "rap sheets" citing the application of Exemptions (a) and (c). Unsatisfied with this response, Mr. Dreslinski petitioned this office and appeal SPR17/ 1165 was opened as a result. The Department provided another response to Mr. Dreslinski on September 16, 2017 indicating they were withholding the records under Exemption (a), (c) and (f). Mr. Dreslinksi is now appealing the Department's supplemental response for lack of specify in reasoning for withholding the records under the indicated exemptions. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department intends to provide Mr. Dreslinski with a response to his appeal. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Dreslinski with a response within ten business days. It is preferable to send an electronic copy of this response to this-office at pre@sec.state.ma.us. Mr. Dreslinski may appeal the substantive nature of the Department's response within ninety days.
