Murray Supervisor of Records October 24, 2017 SPR17/1509 Peter Duarte Dear Mr. Duarte: I have received your petition appealing the response of Department of Correction (Department) to your request for public records. The requirements for an appeal are follows: Such appeal shall be in writing and shall include a copy of the letter by which the request was made. The Supervisor shall accept an appeal only from a person who had made his or her request in writing. An oral request, while valid as a public records request pursuant to 950 C.M.R. 32.05 (3), may not be the basis for an appeal under 950 CMR 32.08. Nonetheless, after a representative from the Department was made aware of your appeal, a representative noted their willingness to provide a response. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Duarte with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Duarte may appeal the substantive nature of the Department's response within ninety days.
