Taveira Town Clerk Town of Swansea 81 Main Street Swansea, MA 02777 Dear Ms. Taveira: I have received the petition of Patrick Higgins appealing the nomesponse of the Swansea Town Clerk (Town) to his request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Higgins requested copies of email correspondence from an identified individual. Claiming to still not yet have received a response, Mr. Higgins petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Town intends on providing Mr. Higgins with a response to his appeal. Accordingly, I will consider this administrative appeal closed with the proviso that the Town provide Mr. Higgins with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Higgins may appeal the substantive nature of the Town's response within ninety (90) days.
