Box 9106 Concord, MA 01742 Dear Attorney O'Donnell: I have received the petition of Jose Correia appealing the response of the Department of Corrections, MCI Concord (Department) to his request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Correia requested a copy of video footage of an· identified incident. Unsatisfied with the Department's response, which noted their intention to withhold the footage under Exemption (n) of the Public Records Law, Mr. Correia petitioned this office and this appeal was opened as a result. It should be noted however, that the Department claims to have offered Mr. Correia an opportunity to view the aforementioned footage, as well as offered photographs. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department intends on providing Mr. Correia with a supplemental response, focused on addressing the concern outlined.in his appeal. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Correia with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Correia may appeal the substantive nature of the Department's response within ninety days.
