Box 9106 Concord, MA 0 1742 Dear Ms. Roth: I have received the petition of Thomas Flannery appealing the nonresponse of the Department of Correction - MCI Concord (Department) to a request for public records. G. L. c. 66, 9 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Flannery requested copies of invoices for two account payments. Claiming to not yet have received a response, Mr. Flannery petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department never received Mr. Flannery's October 16" request. The Department indicated they would provide Mr. Flannery with a response. Accordingly, I will now consider this administrative appeal closed with the proviso that the Department provide said response to Mr. Flannery, provided in accordance with the Public Records Law and its Regulations.
