Department of State Police - Legal Office 470 Worcester Road Framingham, MA 01702 Dear Attorney Brunelli: I have received the petition of Seth Kershner appealing the nomesponse of the Department of State Police (Department) to a request for public rec_ords. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Kershner requested"[c ]opies of all photographs, pictures, audio, video or other recordings of protests and protestors taken or maintained by your agency (Department) and relating to the pipeline protests occurring in Sandisfield, Mass.;' Subsequent to the intervention by a staff member of the Public Records Division, I learned that on November 8, 2017 the Department indicated that a response was provided and that "the records had to be mailed because the records were too large to be e-mailed." Accordingly, I will now consider this administrative appeal closed. Mr. Kershner may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1).
