Murray Supervisor ofR ecords November 29, 2017 SPR17/1622 Jason Meeks (W92526) Souza-Baranowski Correctional Center PO Box 8000 Shirley, MA 01464 Dear Mr. Meeks: I have received your petition appealing the response of the Department of Corrections - MCI Concord (DOC) to your request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). The requirements for an appeal are as follows: Such appeal shall be in writing, and shall include a copy of the letter by which the request was made and, if available, a copy of the letter by which the custodian responded. The Supervisor shall accept an appeal only from a person who had made his or her record request in writing. An oral request, while valid as a public record request pursuant to 950 C.M.R. 32.06(1)(a), may not be the basis of an appeal under 950 C.M.R. 32.08. See 950 C.M.R. 32.08(1)(g). Included in your petition for appeal, you provided this office with a copy of the letter by which the DOC responded. In such letter dated November 1s i, the DOC indicates it is responding to your revised request. Although this office is in possession of your original request from SPRl 7 /1514, a copy of your revised request was not included in your petition for this current appeal. In order for this office to proceed with your petition you must send a copy of the revised request letter you sent to the DOC. Please feel free to re-submit your appeal when you have retrieved copies of all the required documents. Previous Appeal The information provided in your current petition appears to be related to a request that was the subject of a previous appeal. Specifically, you had requested "any and all, not limited all documents concerning, pursuant to investigation (INQ-2017-055) of staff misconduct here at MCI-Concord." I closed SPRl 7 /1514 with the proviso the DOC revise its fee estimate or provide a further explanation of how the fee assessed is expressly provided for and consistent with G. L. c. 66, § 10(d ). The DOC is advised that this response must be provided to both Mr. Meeks and this office within ten business days of receipt of the Determination letter. Conclusion If your request for records for which this current appeal relates was subject to the previous appeal, please be advised the DOC has indicated it would provide you with a supplemental response. You may appeal the substantive nature of the DOC's supplemental response within ninety days. See 950 C.M.R. 32.08(1). If your request for records for which this current appeal relates was not subject to the previous appeal, you may resubmit your petition for appeal including all required documentation as stated above.
