Murray Supervisor ofR ecords November 30, 2017 SPR17/1635 Jacqueline Reis Records Access Officer Department of Elementary and Secondary Education 7 5 Pleasant Street Malden, MA 02148-4906 Dear Ms. Reis: I have received the petition of Collin Binkley of The Associated Press appealing the nonresponse of the Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Binkley requested, "[a ]n electronic copy of all 2016-17 restraint data that school districts provided to the [D]epartment as required by 603 CMR 46.00." Having received no response, Mr. Binkley petitioned this office. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified that a response would be provided without delay. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed with the proviso that the Department responds to Mr. Binkley's request in a timely manner. Mr. Binkley may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(1 ). Sincerely, ~~ Rebecca S.
