G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Binkley requested, "[a ]n electronic copy of all 2016-17 restraint data that school districts provided to the [D]epartment as required by 603 CMR 46.00." Having received no response, Mr. Binkley petitioned this office. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified that a response would be provided without delay. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed with the proviso that the Department responds to Mr. Binkley's request in a timely manner.
