Olson Department of Health and Human Services City of Newton 1000 Commonwealth Ave Newton, MA 02459 Dear Mr. Olson: I have received the petition of Grace McSorley appealing the nonresponse of the City of Newtown (City) to a request for public records. G. L. c. 66, § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Ms. McSorley requested "an opportunity to inspect or obtain copies of public records that relate or document all contacts or complaints made by any owner or resident of Hammond Gardens from September 15, 2016 to November 10, 2017 regarding issues with heat." Having received no response, Ms. McSorley petitioned this office. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified that a response was provided, dated November 30, 2017. Whereas this matter was opened based upon the City's failure to provide a written response, I will now consider this administrative appeal closed. Ms. McSorley may appeal the substantive nature of the City's response within ninety (90) days. See 950 C.M.R. 32.08(2).
