Staff Counsel Office of the Chief Legal Counsel Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Stelmat: I have received the petition of John Rousseau appealing the response of the Department of State Police (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Rousseau requested records pertaining to Commonwealth Fusion Center and named individuals. It is my understanding that the legal issues surrounding the public status of the records in question are the subject of a dispute in active litigation in the Suffolk Superior Court. See, John D.
