Massachusetts Department of Transportation Office of the General Counsel 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Heather Carit o appealing the response of the Massachusetts Department of Transportation (MassDOT) to her request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Ms. Carito requested "MassDOT Owner's Representative Monthly Report for [the] Casey Arborway Project, Paul Tyrell PE author, September 2017, October 2017, November 2017." Claiming to not yet have received a response, Ms. Carito petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MassDOT intends on providing Ms. Cari to with a response. Accordingly, I will consider this administrative appeal closed with the proviso that MassDOT provide Ms. Carito with said response without delay. It is preferable to send an electronic copy of this response to this office at 12r.~@~c.state.ma.us. Ms. Cari to may appeal the substantive nature of MassDOT's response within ninety days.
