The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor ofR ecords January 2, 2018 SPR17/1761 Ms. Kerri Striebel Records Clerk Pittsfield Police Department 39 Allen Street Pittsfield, MA 01201 Ms. Striebel: I have received the petition of Barry Ryan, Esq. appealing the response of the Pittsfield Police Department (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Ryan requested a number ofrecords relating to his client. Subsequent to the intervention by a staff member of the Public Records Division, this office was notified that the Department provided a supplemental response on December 29, 2017 which included responsive records along with an explanation that the remaining records do not exist in the custody of the Department. Whereas this matter was opened based upon the Department not providing existing documents to Attorney Ryan, I will now consider this administrative appeal closed. Attorney Ryan may appeal the substantive nature of the response within ninety days. See 950 C.M.R. 32.08(1 ). Sincerely, ~~ Supervisor of Records cc: Barry Ryan, Esq.
