Records Access Officer Massachusetts Department of Transportation Ten Park Plaza, Suite 3510 Beston, MA 02116 Dear Attorney Doyle: I have received the petition of Sidney Hayes appealing the nonresponse of the Massachusetts Department of Transportation (MassDOT) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Hayes requested copies of various policies, procedures, regulations, and other related material. Claiming to not yet have received a response, Ms. Hayes petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that MassDOT responded to Ms. Hayes’ request with a response sent on January 17, 2018. Whereas the basis of this appeal was opened as a result of MassDOT’s failure to provide a written response, I will now consider this administrative appeal closed. Ms. Hayes may appeal the substantive nature of MassDOT’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Wueeo #liucco S.
