Assistant City Solicitor City of Brockton 45 School Street Brockton, MA 02301 Dear Attorney Fisher: I have received the petition of Ron Matta appealing the nonresponse of the Brockton Police Department (Department) to his request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Matta requested a copy of a 14 page investigative report on a specifically identified individual. Claiming to not yet have received a response, Mr. Matta petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Brockton Law Department is working to compile the requested records and intends on providing Mr. Matta with a written response. Accordingly, the Department is hereby ordered to provide a response to Mr. Matta made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Matta may appeal the substantive nature of the Department's response within ninety days.
