The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division

Rebecca S. Murray Supervisor of Records

January 18, 2018 SPR18/058 Kerry A. Collins, Esq. Legal Counsel Massachusetts State Police Crime Laboratory 124 Acton Street Maynard, MA 01754

Dear Attorney Collins

I have received the petition of Alex Scesny appealing the nonresponse of the Massachusetts State Police Crime Laboratory (Lab) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Scesny requested two identified reports within the possession of the Lab. Claiming to not yet have received a response, Mr. Scesny petitioned this office and this appeal was opened as a result.

Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Lab provided Mr. Scesny with a written response indicating that they are working to compile the requested records and intend on providing them free of charge. Accordingly, the Lab is hereby ordered to provide Mr. Scesny with a response within ten business days. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Scesny may appeal the substantive nature of the Lab’s response within ninety days. See 950 C.M.R. 32.08(1).

Sincerely,

Rebecca S. Murray U
