Dear Attorney Ciollo:

I have received the petition of John P. Seferiadis appealing the nonresponse of the Massachusetts Bay Transportation Authority (MBTA) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Seferiadis requested records of job applications for identified positions in the MBTA. Claiming to not yet have received a response, Mr. Seferiadis petitioned this office and this appeal was opened as a result.

Procedure for appeals

While it appears that Mr. Seferiadis did not copy the MBTA on his petition for an appeal, a Public Records Division staff member provided the MBTA with a copy of the appeal file to assist with responding to this appeal. In petitioning the Supervisor, "the requester shall provide a

copy of such petition to the records access officer associated with such petition." 950 C.M.R. 32.08(1)(h). ,

Order

Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the MBTA is working to compile the requested records and in the meantime intends on providing Mr. Seferiadis with a written response addressing his concerns. Accordingly, the MBTA is hereby ordered to provide a response to Mr. Seferiadis made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Seferiadis may appeal the substantive nature of the MBTA’s response within ninety days. See 950 C.M.R. 32.08(1).
