Dear Ms. Samson:
I have received the petition of Scott M. Carroll, Esq. of Bovle & Shaughnessy Law PC appealing the response of the Boston Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Lauren Hatch, Esq., also of Boyle & Shaughnessy Law PC, originally requested “{a]ll documents in the possession or contro! of the Boston Police Department related to the April 8, 2014 incident involving Christopher McCarthy that occurred at Davitt Street and Savin Hill Avenue, Boston,
Massachusetts. These documents include, but are not limited to all logs, photographs, reports, etc.”
Subsequent to the intervention by a staff member of the Public Records Division, this office was notified that the Department provided a supplemental response on January 26, 2018 which included responsive records. Whereas this matter was opened based upon the Department not providing existing documents to Attorney Carroll, I will now consider this administrative
appeal closed. Attorney Carroll may appeal the substantive nature of the response within ninety days. See 950 C.M.R. 32.08(1).
