Stacy appealing the nonresponse of the Department of Correction — MCI Shirley (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Stacy requested a letter sent to the Department by an identified individual. Claiming to not yet have received a response, Mr. Stacy petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Department was made aware of this appeal, a representative within the Department noted their willingness to provide a response. Accordingly, the Department is hereby ordered to provide a response to Mr. Stacy made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Stacy may appeal the substantive nature of the Department’s response within ninety days.
