Boston, MA 02108 _ Dear Attorney Delaplain: I have received the petition of Colman Herman appealing the nonresponse of the Massachusetts Department of Environmental Protection (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Herman requested to arrange a time when he could visit the Department to view all documents related to an identified school’s waterways license application as well as to view previously withheld emails with attachments. Having received no response, Mr. Herman petitioned this office. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified on January 23, 2018, the Department communicated to Mr. Herman the requested records were located and they would make them available by mail on a thumb drive or he could view them at the Department. I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
