Silvia Records Access Officer Department of Correction 50 Maple Street, Suite 3 Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Emory Snell, Jr. appealing the nonresponse of the Department of Correction (Department) to his request for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Snell requested records relating to the costs of utilities in MCI Concord. Claiming to not yet have received a response, Mr. Snell petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department is working to compile the requested records, and in the meantime provided Mr. Snell with a written response, dated January 17, 2018. Accordingly, the Department is hereby ordered to provide a response to Mr. Snell made in · accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Snell may appeal the substantive nature of the Department's response within ninety days.
