Legal Counsel Massachusetts Port Authority One Harborside Drive, Suite 200s East Boston, MA 02128 Dear Attorney Carvalho: I have received the petition of Ms. Susanna Bohrne appealing the nonresponse of the Massachusetts Port Authority (Authority) to requests for public records. G. L. c. 66, 5 10A; see & 950 C.M.R. 32.08(1). Specifically, Ms. Bohrne requested copies of "the current lease agreement or agreements between JetBlue Airways and Massachusetts Port Authority," "the Massachusetts Port Authority's FY2017 Business Plan and FY2018 Business Plan," and "any materials describing or discussing the Massport Capital Program that have been or will be provided to the Massport Board for their consideration at the February 201 8 Board meeting." Claiming to not yet have received a substantive response, Ms. Bohme petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Authority is working to compile the requested records and intends on providing Ms. Bohrne with a written response in the meantime, addressing her concerns. Accordingly, the Authority is ordered to provide a response to Ms. Bohme made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre0sec.state.ma.u~M. s. Bohme may appeal the substantive nature of the Authority's response within ninety days. 950 C.M.R. 32.08(1). Sincerely, - Rebecca S.
