Silvia Records Access Officer Department of Correction 50 Maple Street, Suite 3 Milford, MA 0 17 57 Dear Ms. Silvia: I have received the petition of Attorney Merritt Schnipper appealing the nonresponse of the Department of Correction (Department) to a request for public records. G. L. c. 66, 5 1O A; -see -also 950 C.h4.R. 32.08(1). Specifically, Attorney Schnipper requested five categories of records concerning Department statistics. Claiming to not yet have received a response, Attorney Schnipper petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department responded to Attorney Schnipper's request with a response sent on February 14,2018 . Whereas the basis of this appeal was opened as a result of the Department's failure to provide a written response, I will now consider this administrative appeal closed. Attorney Schnipper may appeal the substantive nature of the Department's response within ninety (90) days. 550 C.M.R. 32.08(1). C/ Rebecca S. Murray Supen~isoro f Records cc: Menitt Schnipper, Esq.
