Berberena, Jr. appealing the nomesponse of the Department of Correction-MCI Shirley (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Berberena requested records related to himself and the death of an identified individual. Claiming to not yet have received responsive records, Mr. Berberena petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member ofthe Public Records Division, I learned that the Department responded to Mr. Berberena's request with a response sent on March 1, 2018. Accordingly, as the basis of this appeal was the Department's failure to provide a substantive written response, I will now consider this administrative appeal closed.
