Cote Vice President of Human Resources Berkshire Community College 1350 West Street Pittsfield, MA 01201 Dear Ms. Cote: I have received the petition of Ms. Melissa Ptacek appealing the nonresponse of the Berkshire Community College (College) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Ptacek requested records related to the employment and qualifications of an employee of the College. Claiming to not yet have received a response, Ms. Ptacek petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the College responded to Ms. Ptacek's request with a response sent on March 6, 2018. Accordingly, as the basis of this appeal was the College's failure to provide a substantive written response, I will now consider this administrative appeal closed. Ms. Ptacek may appeal the substantive nature of the College's response within ninety days. See 950 C.M.R. 32.08(1).
