City of Boston - Public Records 1 City Hall Square, Room 615 Boston, MA 02201 Dear Attorney Wiiliams: I have received the petition of Adam Vaccaro of the Boston Globe appealing the response of the City of Boston (City) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on January 10, 2018, Mr. Vaccaro requested the following categories of records: "All data provided by Uber Technologies to the City of Boston under the data sharing agreement between the City and the company, signed Jan. 2015, and under any subsequent extensions of the contract. The original contract required Uber to share with the City: a. Anonymous pick-up and drop-off location of each Uber trip, by zip Code Tabulation Area (ZCTA) and neighborhood ... b. The date-stamp and approximate time-stamp of each trip that originates and/or ends in the city; c. The duration of each trip that originates and/or ends in the city; d. Wait time for rideshare vehicles to arrive ..." Mr. Vaccaro indicated that aside from requesting all the data above, the records should also include" ... any additional information Uber was required to provide under this agreement or subsequent extensions." On January 10, 2018, the City notified Mr. Vaccaro of the receipt of his request and indicated that a representative from the City would look into the matter. According to Mr. Vaccaro, two weeks later he was informed that the City is "reviewing [his] request and will provide a written response soon." Contending that "[t]he City's response has been inadequate," Mr. Vaccaro petitioned this office and this appeal, SPRl 8/320, was opened as a result. Subsequent to the intervention by a staff attorney of the Public Records Division, I learned that a representative from the City intends to provide Mr. Vaccaro with a response to his request. Accordingly, I will consider this administrative appeal closed. The City is hereby ordered to provide Mr. Vaccaro with said response, in a manner consistent with this order, the Public Records Law, and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
