Box 606 Vineyard Haven, MA 02568 Dear Ms. Conklin: I have received the petition of Mr. Theodore Saulnier appealing the nonresponse of the Town of Tisbury (Town) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Saulnier requested records of employment action taken against an identified individual. Claiming to not yet have received a response, Mr. Saulnier petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Town was made aware of this appeal, a representative within the Town noted their willingness to provide a substantive response. Accordingly, the Town is hereby ordered to provide a response to Mr. Saulnier made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Saulnier may appeal the substantive nature of the Town's response within ninety days. See 950 C.M.R. 32.08(1).
