Silvia Records Access Officer Department of Correction 50 Maple Street, Suite 3 Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Mr. John Rousseau appealing the nonresponse of the Department of Correction (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Rousseau requested records related to machinery used at a closed MASAC facility. Claiming to not yet have received a response, Mr. Rousseau petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department is working to compile the requested records and intends on providing Mr. Rousseau with a written response in the meantime, addressing his (;Oncems. Accordingly, the Department is hereby ordered to provide a response to Mr. Rousseau made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Rousseau may appeal the substantive nature of the Department response within ninety days.
