Boyle: I have received the petition of Mr. Philip Marcelo appealing the response of the Boston Police Department (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Marcelo requested records related to a federal grant. Claiming to not yet have received a s1,1bstantive response, Mr. Marcelo petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department is working to compile the requested records and intends on providing Mr. Marcelo with a written response in the meantime, addressing his concerns. Accordingly, the Department is hereby ordered to provide a response to Mr. Marcelo made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Marcelo may appeal the substantive nature of the Department's response within ninety days.
