William Borders Lynn Police Department 300 Washington Street Lynn, MA 01902-4718 Dear Capt. Borders: I have received the petition of Mr. Dennis Toomey, Esq. appealing the nonresponse of the Lynn Police Department (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Toomey requested records related to an incident on or about April 2, 1994. Claiming to not yet have received a response, Attorney Toomey petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department is working to compile the requested records and has corresponded with Attorney Toomey in the meantime, addressing his concerns. Accordingly, the Department is hereby ordered to provide a response to Attorney Toomey made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Toomey may appeal the substantive nature of the Department's response within ninety days.
