The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records May 9, 2018 SPRlS/569 Roxanne F. Alteri Records Department Clerk Department of Correction -NCCI 500 Colony Road Gardner, MA 01440 Dear Roxanne Alteri: I have received correspondence from Michel P. Dreslinski appealing the response of the Department of Correction-North Central Correctional Institution (Department) to a request for public records. G. L. c. 66, § lO(A); see also 950 C.M.R. 32.08(1). Specifically, on April 1, 2018, Mr. Dreslinski requested all incident reports created/received regarding an identified individual from 10-31-2017 through 03-31-2018. April 1i ii Response Letter On April 12, 2018 you informed Mr. Dreslinski that "[i]f you need copies of any incident report you must contact the IPS Department and request the incident reports through them." Current Appeal Unsatisfied with the Department's response, Mr. Dreslinski petitioned this office and as a result SPR18/569 was opened. In a letter dated April 24, 2018, Mr. Dreslinski expressed to this office that the Department he was instructed to contact does not have a Record Access Officer. It is my understanding that you discussed this matter with a member of the Public Records Division Staff. Conclusion In light of the Department's April 12th letter and Mr. Dreslinski's April 24, 2018 letter, the Department is advised to provide Mr. Dreslinski a response further detailing the entity that may have created or received the records he seeks.
