Office of the City Clerk City of Springfield 36 Court Street Springfield, MA 01103 Dear Attorney Wilson: I have received the petition of Anthony Bongiorni appealing the nonresponse of the City of Springfield (City) to a request for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Bongiorni requested records related the City's recycling provider. Claiming to have received no response, Mr. Bongiorni petitioned this office, and this appeal was opened as a result. Subsequent to intervention by a Public Records Division staff member, this office was notified that the City had no record of Mr. Bongiorni's initial request. Nevertheless, after a representative of the City was made aware of this appeal, they expressed their willingness to provide a response. Accordingly, the City is hereby ordered to provide a response to Mr. Bongiomi made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. Mr. Bongiorni may appeal the substantive nature of the City's response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
