Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Heather Cari to appealing the response of the Massachusetts Department of Transportation (Department) to a request for public records. G. L. c. 66, § IOA; see also 950 C.M.R. 32.08(1). Specifically, on April 25, 2018, Heather Carito requested, "Barletta Heavy Division Casey Arborway Schedule Update Narrative (Draft and Final) for February 2018 (UP24) and March 2018 (UP25). Casey project: MassDOT Owner's Representative Monthly Report, author Paul J. Tyrell, P.E., for December 2017, January 2018, February 2018 and March 2018." Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department provided Ms. Carito records responsive to her request by certified mail on May 1, 2018. Accordingly, I will now consider this administrative appeal closed. Ms. Carito may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1).
