The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records May 30,2018 SPRl81716 Rebecca Caron City of Fall River-Public Schools 417 Rock Street Fall River, MA 02720 Dear Rebecca Caron: I have received correspondence from Tim McGuire appealing the response of the City of Fall River Public Schools (School) to a request for public records. G. L. c. 66, 10(A); see also 950 C.M.R. 32.08(1). Specifically, on April 10,2018 , Mr. McGuire requested "all documents including e-mails distributed by the faculty advisor to the Durfee High School Chapter of the Gay Straight Alliance ('GSA') to students who are members of that group." In a letter to this office dated May 15, 201 8, Mr. McGuire writes, "the materials produced indicate two pdf files were distributed to students. The materials I received do not appear to include the content of those files. On May 6, 2018, I inquired of Ms. Casey if she could forward the contents of those pdf files." Subsequent to the intervention by a staff member of the Public Records Division, I learned that Ms. Casey no longer works at the School and that the School subsequently provided Mr. McGuire records responsive to his request on May 6,2018 . It is my understanding that the School provided Mr. McGuire the responsive records once more in an email dated May 30,2018 . In light of the School's May 6th and May 3ot" responses, I will now consider this administrative appeal closed. Mr. McGuire may appeal the substantive nature of the School's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Supervisor of Records cc: Tim McGuire One Ashburton Place, Room 1719, Boston, Massachusetts 02108 (617) 727-2832. Fax: (617) 727-5914 sec.state.ma.us/pre pre@sec.state.ma.us
