Murray Supervisor ofR ecords May 23, 2018 SPR18/736 Helene Bettencourt Massachusetts Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148-4906 Dear Helene Bettencourt: I have received the petition of Rachel Solares appealing the response of the Massachusetts Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Solares requested an investigation report concerning educator misconduct during the March 2018 ELA MCAS testing. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department provided Ms. Solares a response dated May 23, 2018. Accordingly, I will now consider this administrative appeal closed. Ms. Solares may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1).
