Kelley Town Clerk Town of Oxford 325 Main Street Oxford, MA 01540-1739 Dear Ms. Kelley: I have received the petition of AE Seabass appealing the response of the Town of Oxford (Town) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, AE Seabass requested records on April 25, 2018 and appealed the Town's May 4, 2018 and May 11, 2018 responses. I understand the Town provided AE Seabass redacted executive session minutes. However, the May 30, 2018 appeal petition did not include a copy of the April 25th request letter. The appeal also did not contain copies of the Town's May 4th and May 11th responses, nor a copy of the responsive records provided. Please note that an appeal shall be in writing, and shall include a complete copy of the letter by which the request was made, including in the case of electronic communications all header information indicating time, date, subject, sender and recipient email addresses; and A complete copy of all written responses associated with requests subject to the petition for appeal. See 950 C.M.R. 32.08(1)(g)(l),(2). Without these documents, I am unable to opine further on this matter. AE Seabass may resubmit the appeal upon retrieval of copies of all the required documents. It should also be noted that issues related to the release of executive session minutes may invoke the Open Meeting Law. An interpretation of the Open Meeting Law falls within the authority of the Office of the Attorney General (AGO). See G. L. c. 30A, § 23. Therefore, it may be appropriate to contact the AGO about this issue.
