Legal Advisor Cambridge Police Department 125 Sixth Street Cambridge, MA 02142 Dear Attorney Mulcahy: I have received the petition of Michael Dreslinksi appealing the nomesponse of the City of Cambridge Police Department (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, in a request dated April 16, 2018, Michael Dreslinski requested three categories of records related to price quotes and invoices for charges for painting and lettering a specific Department vehicle, specifications and instructions provided to vendors regarding painting and lettering the vehicle, and records identifying the font name of letters applied to the vehicle. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days of receipt of the request. G. L. c. 66, § lO(a), (b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § lO(b). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. After the intervention by a staff member of the Public Records Division, it remains unclear whether the Department received this request. I understand the Department was provided a copy of the file associated with the appeal which included the April 16th request. The Department must provide a response to the request under G. L. c. 66, § 1O (b ). Accordingly, the Department is ordered to review the request made by Mr. Dreslinski and provide a written response to Mr. Dreslinski, made in accordance with the Public Records Law, its Regulations and this order within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
