Carrier appealing the nonresponse of the Department of Correction to his request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Carrier requested "Your Public Records for the following information pertaining to December 24-26, 2016 and December 23-26, 2017: Any/all information about the total salary spent on the above dates to include Maintenance, Correctional, Recreational and Support staff; Any/all information about the total number of personal, vacation, sick, FMLA, compensation and missed days that were granted during this time period; Any/all information about the total number of DOC staff that worked on these days noted above." Having received no response, Mr. Carrier petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days ofreceipt of the request. G. L. c. 66, § lO(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § 1O (b ). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of the Public Records Division staff, it remains unclear whether a response was provided. Accordingly, the Department of Correction is hereby ordered to provide Mr. Carrier with a response to the request, prepared in a manner consistent with this order, the Public Records Law and its Regulations. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
