Rousseau: I have received the petition of Karina Wilkinson appealing the response of the Bristol County Sherriff's Office (Office) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Wilkinson requested "documents containing inmate calling -----s~e~rv·ice provider phone rates and site commission percemages, as well astnecurrent contract for inmate calling service in correctional facilities in the county," as well as "any documents that show the number of immigrant detainees currently being held on behalf of ICE" and finally " any documents showing the amount of compensation the jail receives from ICE per detainee per night and the contract under which the county holds detainees on ICE's behalf." Having received no response, Ms. Wilkinson petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days ofreceipt of the request. G. L. c. 66, § lO(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § 1O (b ). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of the Public Records Division staff, it remains unclear whether a response was provided. Accordingly, the Office is ordered to provide Ms. Wilkinson with a response to the request, prepared in a manner consistent with this order, the Public Records Law and its Regulations. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
