Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Ryan Bagwell appealing the response of the Massachusetts Department of Transportation (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Ryan Bagwell requested "Copies of all crash reports involving non-motorists at locations in Melrose, MA in 2016 and 2017" and "Data from all Massachusetts uniform citations issued for violations in Melrose, MA in 2017. Please include data from the following fields: Type (arrest, civil or criminal), Date, Time, Officer ID, Location, Violator's City, Violator's State, Offense chapter/ section, Offense description (including speed details if speeding was the offense), Offense cost assessment, Total cost assessment, Please note that a nearly identical data set was provided to me on May 24, 2017 for the calendar year 2016." Having received no response, Ryan Bagwell petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days ofreceipt of the request. G. L. c. 66, § IO(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § IO(b). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of the Public Records Division staff, the Department has said that they are working on producing the request. Accordingly, the Department is hereby ordered to provide Ryan Bagwell with a response to the request, prepared in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days.
