The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records August 3,20 18 SPR1811079 Mr. Michael Ward Town of Clinton 242 Church Street Clinton, MA 0 15 10 Dear Mr. Ward: I have received the petition of Stephen Townsend appealing the response of the Town of Clinton (Town) to a request for public records. G. L. c. 66, 5 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Townsend requested "statistical data of 'earth removed', including slips, notes, logs, etc. in this regard from 260 Sterling St. Clinton, MA 01 5 10, in conjunction with a Special Permit for earth removal approved by the Board of Selectmen for James and Mary Litterio in October 201 7" particularly "the volume of earth removed, number of truck loads, and days removal occurred to date." Having received no response, Mr. Townsend petitioned this office. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified that a response was provided, dated August 3,2018. Whereas this matter was opened based upon the Town's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Townsend may appeal the substantive nature of the Town's response within ninety days. 950 C.M.R. 32.08(1). Sincerely, V Rebecca S.
