Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3 510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Heather Carito appealing the response of the Massachusetts Department of Transportation (MassDOT) to her request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Carito requested "Barletta Heavy Division Casey Arborway Schedule Update Narrative (Draft and Final) for April 2018 (UP26)." MassDot provided a response on July 22, 2018, with a link to responsive records and indicating "the remaining record (UP26) will be sent to you as it is received ... on or before July 5, 2018." Having not received a response from MassDot since their July 22nd response, Ms. Carito petitioned our office and appeal SPR18/1158 was opened as a result. Order Accordingly, the MassDOT is hereby ordered provide Ms. Carito with the responsive records, made in accordance with the Public Records Law, its Access Regulations and this order within ten (10) business days. This administrative appeal is now closed. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Carito may appeal the substantive nature of MassDot's response within ninety (90) days.
