Assistant Attorney General Office of the Attorney General One Ashburton Place Boston, MA 02108 Dear Attorney Tarrow: I have received the petition of Ilya Feoktistov appealing the response of the Office of the Attorney General (AGO) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, on July 28, 2018 Mr. Feoktistov requested "[a]ny and all documentation related to the use of the Diversity Training Fund, which was created by the attached agreement among the AGO, Bank of America, and the Boston Foundation. This includes but is not limited to any use whatsoever of the $50,000 with which the fund was created, whether under the official auspices of the fund or otherwise, as well as any other value that might have been added to the Diversity Training Fund or to any other funds arising out of the attached agreement." On August 2, 2018, the AGO provided a response to Mr. Feoktistov indicating it is "still in the process of searching for records that may be responsive to [Mr. Feoktistov' s] request and subject to disclosure under the public records law .... Because of the amount of time necessary to complete this process, the AGO expect[s] to provide [Mr. Feoktistov] with a more substantive response on or before August 9, 2018, i.e., within fifteen (15) business days following the initial receipt of the request ... However, [the AGO] will let [Mr. Feoktistov] know if additional time is necessary." Subsequent to the intervention of Public Records Division staff attorney, this office was notified that another response was provided, dated August 21, 2018. Whereas, this appeal was opened based upon the AGO's August 2nd response, I will now consider this administrative appeal closed. Mr. Feoktistov may appeal the substantive nature of the AGO's August 21st response within ninety business days. See 950 C.M.R. 32.08(1).
