The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records August 15,2018 SPR1811219 Kevin Corridan, Esq. Associate City Solicitor City of Chicopee- Law Department City Hall, Marltet Square 17 Springfield Street Chicopee, MA 0 10 13-2776 Dear Attorney Corridan: I have received the petition from Michael Plaisance appealing the response from the City of Chicopee (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Mr. Plaisance made a public records request on July 10,2018 to the City requesting documents pertaining to the "decision not to renew the contract of the superintendent of the Chicopee Department of Public Works." The City responded on July 11 ,201 8. Mr. Plaisance appealed the Town's response to this office via email on August 10,2018 . Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days of receipt of the request. G. L. c. 66, 5 10(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, 5 lO(b). All records custodians must comply with botli the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified that a response was provided, dated August 14,2018 . Mr. Plaisance confirmed the City provided him the requested documents. Whereas this matter was opened based upon the City's lack of written response, I will now consider this administrative appeal closed.
