The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records August 28,2018 SPR1811228 Julie Ciollo, Esq. Assistant General Counsel Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 3 9 10 Boston, MA 02 1 16 Dear Attorney Ciollo: I have received the petition of Sakib Khan, Esq. appealing the nonresponse of the Massachusetts Bay Transportation Authority (Authority) to a request for public records. G. L. c. 66, 5 lOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Khan requested records for four Authority projects. Having received no response, Attorney Khan petitioned this office. Although Attorney Khan initially made his request to the Department of Transportation (Department), subsequent to the intervention by a member of the Public Records Division, this office learned that the records are most likely in the Authority's possession. I understand the Authority provided a response to Attorney Khan on August 16,2018 . Whereas this matter was opened based upon Attorney IUlan not having received a written response, I will now consider this administrative appeal closed. Attorney Khan may appeal the substantive nature of the Authority's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S. Murray Supervisor of Records cc: Sakib Khan, Esq.
