Murray Supervisor ofR ecords August 30, 2018 SPR18/1260 Helena Rafferty Deputy Chief Canton Police Department 1492 Washington St Canton, MA 02021 Dear Deputy Chief Rafferty: I have received the petition of Charles Dyous appealing the nonresponse of the Canton Police Department (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Dyous requested records of an interview conducted by an identified individual as well as any records pertaining to the interview. Claiming to not yet have received a response, Mr. Dyous petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Department was made aware of this appeal, a representative within the Department noted their willingness to provide Mr. Dyous with a response. Accordingly, the Department is ordered to provide a response to Mr. Dyous made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Dyous may appeal the substantive nature of the Department's response within ninety days.
